Welcome to SkyMate ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of the SkyMate website located at www.skymate.tech (the "Website") and the SkyMate AI VFR Companion software application (the "Software"), collectively referred to as the "Service".
By accessing the Website or purchasing and using the Software, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
1. About the Service
SkyMate is an AI-powered VFR (Visual Flight Rules) companion application designed for use with Microsoft Flight Simulator 2024 ("MSFS 2024"). SkyMate is an independent third-party product and is not affiliated with, endorsed by, or sponsored by Microsoft Corporation or Asobo Studio.
2. Eligibility
You must be at least 18 years old or have the consent of a parent or legal guardian to use the Service. By agreeing to these Terms, you represent that you meet this requirement.
3. Account and License
3.1 License Grant
Upon completing a valid purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on your personal computer for personal, non-commercial use in connection with MSFS 2024.
3.2 License Key
Access to the Software is provided through a unique license key delivered to you at the time of purchase. You are responsible for keeping your license key confidential. Sharing, distributing, or publishing your license key is strictly prohibited and may result in the revocation of your license without refund.
3.3 Restrictions
You may not:
- Copy, modify, distribute, sell, lease, sublicense, or otherwise transfer the Software or any rights therein.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
- Use the Software for any commercial purpose without prior written consent from us.
- Use the Software in any manner that violates applicable laws or regulations.
4. Free Trial
We offer a free trial period of 24 hours, allowing you to evaluate the Software before making a purchase. The trial provides access to the full functionality of the Software. No payment information is required to start the trial. Once the trial period expires, continued use of the Software requires a valid purchase.
5. Pricing and Payment
5.1 One-Time Purchase
The Software is available for a one-time purchase. The current price is displayed on the Website at the time of purchase. All prices are listed in the currency specified on the checkout page.
5.2 Payment Processing
All payments are processed securely through Lemon Squeezy, our authorized payment processor. By completing a purchase, you also agree to Lemon Squeezy's terms of service. We do not store or have direct access to your payment card details.
5.3 Taxes
Applicable taxes (such as VAT or sales tax) may be added to the purchase price depending on your location. Lemon Squeezy calculates and collects these taxes as required by law.
6. Refund Policy
All sales are final. Due to the digital nature of the Software and the availability of a free 24-hour trial period that allows you to fully evaluate the Software before purchasing, we do not offer refunds after purchase.
We encourage all customers to take full advantage of the free trial to ensure the Software meets their needs before completing a purchase.
7. Software Updates
We may, at our discretion, release updates, patches, or new versions of the Software. These updates may be necessary for the continued functionality of the Software, especially in response to changes in MSFS 2024. We do not guarantee the availability, frequency, or scope of any updates.
8. Intellectual Property
All content on the Website and within the Software, including but not limited to text, graphics, logos, icons, images, audio, software code, and documentation, is the property of SkyMate and is protected by applicable intellectual property laws.
"SkyMate" and the SkyMate logo are trademarks of Jose Caceres. Unauthorized use of our trademarks is prohibited.
"Microsoft Flight Simulator" and "MSFS" are trademarks of Microsoft Corporation. All other trademarks referenced herein are the property of their respective owners.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Software will be compatible with all hardware or software configurations.
- The Software will function without interruption or errors.
- The Software will remain compatible with future versions of MSFS 2024 or any updates thereto.
- Any defects in the Software will be corrected.
SkyMate is designed for use within a flight simulation environment only. It is not intended for, and must not be used for, real-world aviation navigation or decision-making.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKYMATE, ITS OWNER, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
11. Third-Party Services
The Software is designed to work within MSFS 2024. We are not responsible for any changes, updates, or discontinuation of MSFS 2024 by Microsoft that may affect the functionality of the Software. Your use of MSFS 2024 is governed by Microsoft's own terms and conditions.
12. Privacy
We respect your privacy. The Software does not collect, transmit, or store personal data or usage information. No telemetry, analytics, or tracking data is gathered through the Software.

13. Termination
We reserve the right to terminate or suspend your license at any time, without prior notice, if you breach any of these Terms. Upon termination, you must immediately cease all use of the Software and destroy any copies in your possession.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Colombia.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with any policies or guidelines referenced herein, constitute the entire agreement between you and SkyMate regarding your use of the Service and supersede any prior agreements or understandings.
